Privacy and cookies policy
Part I – General principles
§1 Administrator
- The administrator of your personal data is us, i.e. the Rybnik Earth Theatre having within its structures the River Art Gallery – Rybnik Art Education Centre. In the remainder of this Privacy Policy, we write about ourselves in the first person or refer to ourselves as “Administrator” or “We”.

§2 Terms used in the Privacy Policy
If you see any of the following capitalized terms in the remainder of our Privacy Policy, you should understand them as defined below:
- “Site” – the website, the home page of which is located at the following address www.galeriarzeczna.pl/en/
- “Policy” – means this document, the privacy policy you are reading,
- “GDPR” – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
- “Social media” – the social networks on which we have profiles.
§3 Safeguarding personal data
- We process all personal data that you provide on the Site or that we collect about you in the course of your use of the Site as an Administrator in accordance with the GDPR.
- We use the technical measures required by current data protection legislation to prevent unauthorised persons from obtaining and modifying personal data transmitted electronically, i.e. within our Site.
§4 Your rights regarding personal data
- We process your personal data, therefore:
- you have the right to access your personal data,
- you may rectify it,
- you may request the erasure of your personal data where permitted by the GDPR,
- you have the right to restrict processing, to the extent set out in the GDPR.
- In Parts II – IV of the Policy, you will find information about additional rights. This is because in certain situations, you will have additional possibilities.

§5 The right to object
- Once you have given us your personal data or if we collect it ourselves, you can exercise your right to object. You have this right in two situations where we process your personal data:
- for direct marketing purposes; you do not have to justify such an objection;
- on the basis of our other legitimate interests; such an objection needs to be justified by your particular situation. Write to us about why we should not process your data.

§6 Complaint to the Chairman of the Office for Personal Data Protection
If you believe that we are processing your personal data unlawfully, you can lodge a complaint with a supervisory authority. In Poland, this is the Chairman of the Office for Personal Data Protection, and their website is available at this address: https://uodo.gov.pl
§7 Questions for the Policy and where it is published

If you use these opportunities on our Site, please note the following:
- Why do we need your data, i.e. for what purpose do we process it? For the purposes of:
- identifying participants in workshops, festivals, etc.
- audience identification – for ticket reservations and online purchases
- keeping in touch with our recipients – by sending newsletters and other forms of correspondence
- What are your rights?
- We have described them in § 4 and 5 of the Policy.
- Are you required to give us your details?
- It is voluntary. Without providing your contact details, we may not be able to contact you.
- On what legal basis do we process your data?
- 6(1)(f) GDPR, i.e. our legitimate interest.
- 6(1)(b) GDPR, i.e. taking action at your request prior to the conclusion of a contract – this basis will only apply in the case described in 1(2) above.
- What is our legitimate interest?
- The possibility of selling you a ticket, renting the hall or responding to your message.
- To whom will your data be provided?
- Entities involved in storing personal data for us;
- Entities hosting (storing) the Site.
- How long will we process your data?
For the time required:
- to resolve the case presented by you or to prepare a cooperation proposal for you. Depending on the type of case, also for the time it takes to prove that we have resolved the case correctly, i.e. for the period of the statute of limitations.
- if you enter into a partnership with us, you will be informed separately of the specific data processing rules related to the performance of the contract.
Part II – our social media profiles
§8 Use of our social media profile
If you are using our profile, please note the following:
- Why do we need your data, i.e. for what purpose do we process it?
- to answer any private messages you send to us
- to engage in discussion with you in the comments section of individual posts
- to share our posts with you as a follower of our profile
- marketing by providing information about our services and ourselves through posts we make on our profile, including sponsored posts that are displayed to a wider range of social media users
- statistical, in that social media providers such as Facebook Ireland Ltd. present us with data on the number of times our posts have been displayed, the reach of our posts, the number of interactions and the demographics of our followers; the data presented to us by social media providers is statistical, but is created on the basis of their observations of your behaviour on our profile.
- What are your rights?
These are described in § 4 and 5 of the Policy - Are you required to give us your details?
This is voluntary. However, due to the rules applied by Social media we will see your name (or nickname) or photo if you write to us or comment on our post. - On what legal basis do we process your data?
Article 6(1)(f) GDPR, i.e. our legitimate interest. - What is our legitimate interest?
Responding to your messages and comments, providing you with posts, informing you about our services and ourselves through them, analyzing statistical data related to our profile. - To whom will your data be provided?
Social media operators, such as Facebook and Instagram in particular. - How long will we process your data?
For the time:- needed to resolve the case you have presented. Depending on the type of case, also for the time needed to demonstrate that we have resolved it, i.e. for the period of the statute of limitations for claims;
- of your following of our profile. Remember that you can always delete your comments under our posts, stop following us or cancel your social media account.
Part III – information on cookies
§9 Entering the Site
When you visit the Site, we process the information contained in cookies. Cookies are stored on your terminal device (e.g. computer, tablet, smartphone) and subsequently access the information contained therein. These activities take place according to the principles described below.
§10 What are cookies and why do we use them
- On the Site we use cookies, which are small textual information stored on your terminal device (e.g. computer, tablet, smartphone). Cookies can be read by the Site.
- We store cookies on your computer, phone or tablet and then access the information contained in them for the following purposes:
- to ensure the proper operation of the Site, including maintaining your session;
- marketing by displaying advertisements for our products to you on other websites, including social media, in matching with products you have viewed on the Site,
- statistical and analytical purposes, in particular to enable analysis of your use of the Site.
- In the cases described in points b and c above, processing of your personal data may take place:
- we carry out their processing on the basis of our legitimate interest, i.e. Article 6(1)(f) GDPR;
- our legitimate interest is to conduct marketing of our products that you have viewed on our Site and to match the advertisements displayed to you with your previous activities on the Site, as well as to collect statistical data about your use of our Site to optimize its performance;
- We have set out your rights in relation to this processing in § 4 and 5 of the Policy;
- remember that you can contact us at any time and object to the processing of your personal data for marketing purposes. You do not need to justify this objection;
- We will pass on your personal data to advertising network operators, including social networks;
- we will retain them for the duration of these marketing activities or until you object to further processing for marketing purposes;
- Transfers of personal data outside the European Economic Area will be made when the conditions are met to allow this. We will inform you if this occurs;
- The provision of this personal data is voluntary, and there are no negative consequences if you do not provide it, e.g. by using appropriate blocking software; you will not then see advertisements for our products that are tailored to your activities on the Site, including the products you are viewing.
§11 Types of cookies
- There are several types of cookies on the Site:
- session cookies, which remain in the memory of your web browser until you switch it off,
- temporary files that remain in your browser’s memory until a predetermined period of time has elapsed (maximum 2 years), please note that you can delete such files yourself earlier (§ 16 indicates how to do this),
- permanent, which remain in your browser’s memory until you delete them (in § 16 we indicate how to do this),
- external, coming from providers of analytics tools on the Site.
§12 How to delete cookies
- You can configure your web browser to prevent cookies from being stored on your computer, phone or tablet.
- You can delete cookies once we have stored them. To do so, you can use: the relevant functions of your Internet browser, programs for this purpose or the relevant tools available within your operating system.

§13 Effect of changing browser settings on the use of the Site
Changing the configuration of your web browser to one that prevents or restricts the storage of cookies may result in restrictions on the functionality of the Site. Deleting cookies when using the Site may lead to similar consequences. This means that some of our services will not be available without cookies.
§14 External cookies
- Cookies placed on your computer, phone or tablet may come from other service providers. You can delete these cookies from your device yourself. These cookies are stored on your device for varying lengths of time, depending on the file in question (maximum 2 years).
- The Site contains cookies provided by:
